Probate of an Estate

The probate of an estate is the legal process that can take place after a person passes away. It is highly recommended that you seek the advice of an attorney who will discuss with you the different probate options you might have for your situation. Depending on various factors, you may be able to avoid a full administration of an estate, but this depends on the facts of each case specific situation. There are various examples of different types of probate processes which involve whether a person passes away with a Will or without a Will. For example:

  • probating a Will as a muniment of title only
  • probating a Will and seeking to be appointed as the Independent Executor of an estate
  • probating a Will and seeking to be appointed as an Independent or Dependent Administrator of an estate
  • a Judgment Declaring Heirship
  • Independent Administrations
  • Dependent Administrations
